My Commitment to You:

1. Data Protection: Send Compass is committed to protecting the privacy and security of your personal information. 2. Equipment Insurance: Send Compass equipment is insured and protected to ensure the security and confidentiality of your personal information.
3. Outcome Guarantee: While we cannot guarantee the outcome of any Local Authority (LA) or tribunal decisions, we will do our utmost to promote the child’s best interests and work towards achieving a positive outcome.
4. Hourly Rate: Our services are charged at £20 per hour.

Your Commitment to Me:

1. Payment Terms: All invoices must be paid within 7 days of receipt. Late payments may be subject to additional fees and charges.
2. Cancellations: Cancellations are allowed, but 24 hours’ notice is appreciated to allow us to adjust our schedule.
3. Relevant Documentation: Families agree to send all relevant documentation to enable me to complete the work accurately and efficiently.
4. Changes: Any changes to the agreed plan must be communicated promptly to ensure that we can provide the best service possible.

Your Information:

1. Confidentiality: We will collect personal information about the child and family, which will be kept confidential. All applicable laws and best practices regarding confidentiality will be adhered to.
2. Information Storage: We will store your personal information for as long as it is needed or required by law.

Communication:

1. Free Consultation: We offer a free consultation and no-obligation estimates to help you decide whether our services are the right fit for you.
2. Communication: We offer communication through email, telephone, or video calls, whichever is most convenient for you.

Complaints/Disputes:

1. Negotiation: We are committed to resolving any issues in good faith. If a dispute arises, both parties agree to attempt to resolve it through negotiation.
2. Mediation/Arbitration: If negotiations are unsuccessful, either party may initiate mediation or binding arbitration in a mutually agreed forum.
3. Litigation: If litigation is necessary, this Agreement will be interpreted based on the laws of the UK, regardless of any conflict of law issues. The dispute will be resolved in a court of competent jurisdiction.
4. Legal Fees: The prevailing party in a dispute (the “winner”) will be entitled to recover its legal fees and other reasonable costs if the dispute is resolved through binding arbitration or litigation.

Indemnity Insurance: Send Compass holds indemnity insurance to protect both you and us in case of claims related to the services provided.

Limitation of Liability: To the fullest extent permitted by law, Send Compass will not be held liable for any indirect, special, incidental, or consequential damages resulting from the use of our services, including but not limited to loss of data, profits, or any other damages.

By using our services, you agree that in the event of any issues, you will not bring any legal action against Send Compass unless we are grossly negligent or in breach of our obligations.
